XLS's acquisition of Smart Data Consulting could be read several different ways by the market. The press release called out the acquisition of Smart Data's managed services offering, but with only 22 employees and one office in NY it is hard for eDJ to see how that will significantly expand the relatively large XLS service team. XLS has stated that the acquisition adds Viewpoint service expertise and process efficiency to improve services to Viewpoint customers. Smart Data is already a Viewpoint Gold Partner in the XLS channel and the rest of their services seem to overlap with the current XLS portfolio. eDJ interprets this as XLS buying Smart Data's customer base and key talent at this point.

Xerox Litigation Services has long been a respected litigation support service provider. For the most part, XLS preached to eDJ Group at LegalTech 2012 about the importance of being technology-agnostic even though they had their own technology offerings OmniX and CategoriX. While the company is still somewhat technology-agnostic, it did buy software provider Lateral Data this year, which could signal a move to more use of internal technology only. There is the potential for confusion with the company’s multiple review offerings. Viewpoint is deployed on-premise for do-it-yourself eDiscovery, or Xerox Litigation Service can host the IT components while clients still have full control over all eDiscovery processes and functionality. OmniX, on the other hand, is a completely managed and hosted service. Xerox Litigation Services is helping to lead the predictive coding charge and it will be interesting to see if it can manage the focus necessary to produce great software and high-quality services – not many companies are able to do both.
